Acceptable Use and Content Policy

1. Purpose

1.1 HausTour is a professional property-marketing platform. This Acceptable Use and Content Policy (“Policy”) sets out the rules that govern how you may use the HausTour platform, website, applications, APIs, chatbot integrations, and related services (collectively, the “Service”) provided by Overclock GmbH (“HausTour”, “we”, “us”, “our”).

1.2 This Policy supplements the Terms of Service. Capitalised terms not defined here have the meanings given in the Terms of Service.

1.3 By using the Service, you agree to comply with this Policy. If you do not agree, you must not use the Service.

2. General Standard

2.1 You must use the Service lawfully, honestly, and in good faith, and in a manner consistent with its intended purpose of professional property marketing.

2.2 You are responsible for all content you upload, submit, or generate through the Service (“Customer Content”) and for all activities that occur under your account.

2.3 You must comply with all applicable laws, regulations, industry codes, and professional standards, including those relating to real-estate advertising, consumer protection, competition, and data protection.

3. Prohibited Content

3.1 You must not upload, submit, generate, distribute, or publish through the Service any content that:

  • (a) is unlawful, fraudulent, or facilitates illegal activity;
  • (b) infringes or misappropriates the intellectual property rights, privacy rights, publicity rights, or other rights of any third party;
  • (c) is deceptive, misleading, or designed to create a false impression about a property, service, person, or entity;
  • (d) is defamatory, libellous, threatening, harassing, abusive, or intimidating;
  • (e) contains malware, viruses, trojan horses, worms, ransomware, or any other harmful code or files;
  • (f) contains sensitive personal data, including health data, biometric data, racial or ethnic origin data, political opinions, religious beliefs, trade union membership, sexual orientation data, or criminal records, unless strictly necessary and lawfully permitted;
  • (g) promotes hatred, discrimination, or violence against any individual or group based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, age, or any other protected characteristic; or
  • (h) is obscene, pornographic, sexually explicit, or depicts the sexual exploitation of minors.

4. Property Marketing Standards

4.1 The Service generates AI-assisted property marketing content. You must not use the Service to create or distribute content that:

  • (a) materially misrepresents the condition, size, layout, features, views, or amenities of a property;
  • (b) uses AI-enhanced or AI-generated images in a manner that could deceive a reasonable buyer, tenant, or investor about the actual state of a property;
  • (c) omits material defects or adverse conditions that are required to be disclosed under applicable real-estate law;
  • (d) makes false or unverified claims about energy performance, zoning, building compliance, measurements, or neighbourhood characteristics;
  • (e) publishes AI-generated text, descriptions, room labels, measurements, voiceovers, or claims without first reviewing and verifying their accuracy;
  • (f) distributes any output as final marketing material without human review and approval, ensuring that all factual claims are accurate and all visual representations are not misleading; or
  • (g) violates applicable real-estate advertising standards, fair trading rules, or consumer protection requirements in any jurisdiction where the marketing content is published.

4.2 You are solely responsible for reviewing all AI-generated content before publication and ensuring compliance with applicable law and professional standards.

5. Anti-Discrimination

5.1 You must not use the Service to create property marketing content that discriminates or expresses discriminatory preferences on the basis of race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, family status, disability, age, or any other characteristic protected by applicable law.

5.2 This includes, without limitation, descriptions, imagery, targeting criteria, or distribution practices that would violate applicable housing, equal-treatment, or anti-discrimination laws.

6. Privacy and Personal Data

6.1 You must minimise the personal data contained in content you upload to the Service. Before uploading, you should review materials and, where reasonably practicable, remove or obscure:

  • (a) identity documents, passports, and official identification visible in images;
  • (b) personal or family photographs displayed on walls, shelves, or surfaces;
  • (c) vehicle licence plates;
  • (d) personal or business correspondence, including letters, bills, and notices;
  • (e) financial documents, including bank statements, tax returns, and invoices;
  • (f) medical records, prescriptions, and health-related documents; and
  • (g) images of children, unless you have obtained all necessary parental or guardian consents required by applicable law.

6.2 You are responsible for ensuring that you have the necessary legal basis, consents, and authorisations for any personal data included in Customer Content, in accordance with applicable data protection law.

7. Messaging Channel Rules

7.1 When using the Service through messaging channels (WhatsApp, Telegram, SMS, or similar), you must not:

  • (a) send spam, bulk unsolicited messages, or automated messages through the Service;
  • (b) upload content that you are not authorised to use or distribute;
  • (c) impersonate another person, agent, or entity;
  • (d) harvest, scrape, or collect contact information or personal data from the Service or its messaging integrations;
  • (e) transmit special-category personal data unless strictly necessary and lawfully permitted; or
  • (f) violate the terms of service of the underlying messaging platform.

7.2 You are responsible for ensuring that any phone numbers or contact data used with messaging integrations are provided with appropriate consent.

8. Platform and Security Restrictions

8.1 You must not:

  • (a) reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, algorithms, models, prompts, or underlying technology of the Service, except to the extent such restriction is prohibited by mandatory law;
  • (b) scrape, crawl, or use automated means to extract data or content from the Service beyond the scope of any published API;
  • (c) overload, flood, or otherwise interfere with the performance, availability, or stability of the Service or its infrastructure;
  • (d) probe, scan, or test the vulnerability of the Service or any related system or network without prior written authorisation;
  • (e) circumvent, disable, or tamper with any security, authentication, rate-limiting, or access-control features of the Service;
  • (f) use the Service to build, train, benchmark, or operate a competing product or service, except to the extent such restriction is prohibited by mandatory law; or
  • (g) resell, sublicense, or provide access to the Service to third parties except as expressly permitted by the Agreement.

9. Intellectual Property and Rights Complaints

9.1 If you believe that content on the Service infringes your intellectual property rights, privacy rights, or other legal rights, you may submit a complaint to legal@haustour.ch with the following information:

  • (a) identification of the right claimed to be infringed;
  • (b) identification of the allegedly infringing content, including its location on the Service;
  • (c) your contact information;
  • (d) a statement that you believe in good faith that the use is not authorised; and
  • (e) a statement, under penalty of perjury where applicable, that the information in the notice is accurate and that you are authorised to act on behalf of the rights holder.

9.2 We will review complaints promptly and may remove or restrict access to content that we determine, in our reasonable judgement, infringes third-party rights.

9.3 Repeat infringers may have their accounts suspended or terminated.

10. Enforcement

10.1 We may investigate any suspected violation of this Policy. In response to a confirmed or suspected violation, we may, at our sole discretion and without prior notice:

  • (a) issue a warning to the account holder;
  • (b) remove, disable, or restrict access to content that violates this Policy;
  • (c) block access to messaging channel integrations (WhatsApp, Telegram, SMS, or similar);
  • (d) suspend your access to the Service, in whole or in part;
  • (e) terminate your account and access to the Service;
  • (f) report the violation to law enforcement, regulators, or other relevant authorities; and
  • (g) take any other action we deem necessary to protect the Service, our users, or third parties.

10.2 We may take urgent action, including immediate suspension without prior notice, where we reasonably believe there is a legal, security, or safety risk that requires prompt intervention.

10.3 Accounts that repeatedly violate this Policy may be permanently terminated. We may consider the nature, severity, frequency, and intent of the violations when determining appropriate enforcement action.

10.4 We may cooperate with law enforcement, regulators, courts, and other competent authorities as required or permitted by applicable law, including by disclosing relevant account information and content.

10.5 We are not obligated to monitor all content or activity on the Service, but we reserve the right to do so.

10.6 Enforcement actions are without prejudice to any other rights or remedies available to us under the Agreement or applicable law.

11. Reporting Violations

11.1 If you become aware of any content or activity that you believe violates this Policy, please report it to us at legal@haustour.ch.

11.2 Please include a description of the violation, any relevant URLs, screenshots, or evidence, and your contact information.

11.3 We will review reports in good faith and take appropriate action where warranted. We are not obligated to disclose the outcome of any investigation to the reporter except where required by law.
